Virginia’s Long Road to Legal Cannabis Sales: Retail Market Set for July 2027 Launch

After years of delays, Virginia has finally cleared the path for a regulated adult-use cannabis market. On June 30, 2026, Governor Abigail Spanberger signed a budget compromise that legalizes recreational retail sales starting July 1, 2027. This marks the first Southern state with a full legal cannabis marketplace.


Current Status Adults 21 and older can already possess up to one ounce of cannabis and grow up to four plants at home. That possession limit jumps to two ounces when sales begin next year. Medical cannabis is widely available with few restrictions. But until July 2027, there are still no legal recreational stores — the black market has been filling that gap.


Key Details of the New Market

•  Up to 350 retail licenses statewide, phased in based on demand.

•  A 6% state excise tax at launch, rising to 8% in 2029. Localities can add 1 to 3.5% on top of regular sales tax.

•  Revenue will fund education, behavioral health, public health programs, and a Cannabis Equity Reinvestment Fund to support communities hit hardest by past drug policies.

•  Strong child safety rules: child-resistant packaging, no cartoon ads, no products shaped like animals or toys, and stores must stay at least 1,000 feet from schools and playgrounds.

•  Emphasis on small businesses — the plan includes micro-business licenses and protections against big multi-state operators dominating the market.


The Virginia Cannabis Control Authority will regulate everything, including testing, labeling, and cracking down on illegal sales and the hemp loophole that’s flooded the market with unregulated high-THC products.


This compromise came after earlier bills were vetoed or stalled, with lawmakers from both sides of the aisle working together to balance public safety, equity, and economic opportunity. While some hoped for an earlier 2026 start, the extra time lets regulators build a safer, more competitive system.
